SellYourcell.com User Agreement
Introduction
SellyourCell is an online system enabling users to sell their used or unused wireless handset(s) and other electronics. Our website tenders a real offer for the equipment you enter. We reserve the right to change or void these offers at our sole discretion.
THE USE OF THIS SITE IS GOVERNED BY THE POLICIES, TERMS AND CONDITIONS SET FORTH BELOW IN THIS USER AGREEMENT (\'AGREEMENT\'). PLEASE READ THIS AGREEMENT CAREFULLY. YOUR REGISTRATION, YOUR USE OF THIS SITE AND YOUR PLACEMENT OF A TRADE AND/OR AN ORDER INDICATES YOUR ACCEPTANCE OF THESE POLICIES, TERMS AND CONDITIONS.
WE MAY AMEND THIS AGREEMENT AT ANY TIME BY POSTING THE AMENDED TERMS ON OUR SITE. EXCEPT AS STATED BELOW, THE AMENDED TERMS WILL AUTOMATICALLY BE EFFECTIVE IMMEDIATELY AFTER THEY ARE POSTED.
Minors
As our offers are a legal agreement, they are not available to minors or those otherwise prohibited by law. If you are a minor, or otherwise legally prohibited, please do not use our website. Your right to use SellYourCell.com may be voided if you do not comply with this Agreement.
Required Condition of your Cell Phone(s)
In order to be compensated for submitting your handset, it must work must be 100% functional. As a part of our acceptance testing, We will ensure that the handset it powers up and retains a charge, we will makes a test call, and ensure that all available features function correctly.
In addition, handsets may not have broken cases/faces, antennas, etc. In cases where these components are easily replaceable, we might extend an amended offer. Please see the section below on amended offers.
Do not send any handsets that have water damage, broken screens, or parts rattling around in them.
The handset(s) must have a clear and easy to read Electronic Serial Number on the back of the phone. Items with the ESN removed will not be accepted under any circumstances.
Unfortunately, we are unable to accept phones from the following carriers, Qwest, Virgin Mobile, Earthlink and Amp'd Mobile.
In the case of CDMA handsets (for example: Sprint, Verizon, etc.), the phone must be free and clear for activation. There may not be an outstanding balance on the account, and the phone must not be reported lost or stolen with the carrier.
You must include the battery; please also include the home charger. Feel free to send any other accessories that you do not want such as car chargers, speaker kits or plastic holsters. Please do not send used ear/headsets, though new ones are just fine.
Required Condition of your iPod(s)
In order to be compensated for submitting your iPod, it must work correctly: scroll wheels, buttons, ports, battery, display, hard drive, memory, etc. must all function. Battery must last two hours. iPods must be complete with original AC adapter, cables, software and dock where applicable. iPods with engraving are acceptable. All iPods submitted will be inspected by our staff and the condition will be at the sole discretion of inspecting staff member(s). Incomplete submissions will be considered on a case-by-case basis by our staff.
Payment
Payment will be issued by SellyourCell.com, in the form of a company check, within 30 days of our receipt of the handset(s).
Should an item fail to meet our required conditions, a notification will be sent via email. If there is more than one item on an invoice, accepted items will be paid and rejected items will be handled as described below.
Rejected items:
If an item does not meet our Required Condition guidelines, we will notify the customer, via email, as soon as that decision is made. In the case of a multiple item invoice, any accepted items will be paid as normal.
The notification of a rejected item may not specify exactly which item was rejected, and may not cite the specific reason for rejection. To request this information, please contact our customer service department at cs@sellyourcell.com. Such emails will be answered within 5 business days.
Rejected items may be shipped back to the seller at the seller’s expense. Requests for, and payment for the return of rejected items must be received by us, via email, within 15 days of our notification to the seller. After this time, rejected items will be appropriately recycled and will no longer available for return.
Modified/Amended Offers:
In some cases, when a phone does not pass our required condition standards, but is easily repairable, we will make a modified offer. Modified offers will be sent via email. You have five business days to respond to such an offer. If we do not hear from you within five business days, we will complete the order under the terms of the modified offer.
Accuracy of your Invoice:
To avoid confusion, please ensure that the phone models on your invoice are exactly the models you will be sending. We pay based solely on the handsets we receive. Notification and/or a modified offer is not provided when a handset that arrives differs from one on the invoice.
Valid Offer Timeframe
We will honor our committed offers for 30 days from the time the offer is made, even if the current offer price goes down. However, this offer only extends to handsets that are delivered as invoiced. Any acceptable handset that is not included, or is misrepresented on the invoice will be paid at either the current price for the actual model received at the time of processing, or the price at the time of invoice creation, whichever is lowest.
Honored Offer Policy
Our trade offers are valid only for handsets that meet our handset condition guidelines and determination of adherence to these guidelines is at our sole discretion. In other words, please make sure the handset(s) you send in are working.
Special Offers Policy
Any special offers (coupons, bonus certificates, etc.) are limited to one per invoice and one per household. Coupons are not valid on prior submissions and only valid if received with your phones.
Existing Wireless Service
Hopefully this is common sense, but our attorneys say we need to go over it anyway.
It is your responsibility to cancel any service to handsets sent to SellyourCell, and more to the point, SellyourCell is not responsible for service costs, airtime charges, or any wireless charges of any kind before, during or after the completion of any offer.
If any airtime charges arise, payment for same is solely the responsibility of the wireless subscriber.
Communication:
All communication and notifications regarding a SellyourCell.com transaction will be through email.
It is solely the responsibility of the user to ensure that an accurate email address is provided. It is also the responsibility of the user to remove any encumbrances to email communication, such as junk or spam filters.
Contact Information
The information you provide is used to enhance your experience with SellyourCell.com. We use it to update you on our products and services. We will also occasionally notify you of special offers from SellyourCell.com or our merchant partners. If you ever want to not receive announcements or special offers from us, simply use the unsubscribe options presented in our eMails or send us an e-mail expressing your desire to be removed from our lists to cs@sellyourcell.com.

This Agreement and your membership in no way constitute or give rise to a partnership, joint venture or other relationship between the parties. Each of us will operate under the terms of this Agreement as an independent contractor and not as an agent for the other.
